Terms of Use

By downloading, installing, or using the Chitin app ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

Chitin is an AI companion application that provides conversational interaction through animated avatars with voice, personality, and persistent memory. The Service is available in a free tier with limited daily usage and a paid subscription tier with expanded capabilities.

Chitin offers an optional auto-renewable subscription at $9.99 per month, billed through Apple's App Store. By subscribing, you authorize Apple to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time through Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle.

Pricing may change with notice. Any price change will take effect at the start of the next billing cycle following the notice. Continued use of the subscription after a price change constitutes acceptance of the new price.

All responses provided by Chitin are generated by artificial intelligence. AI-generated content may be inaccurate, incomplete, or inappropriate. Chitin's responses do not constitute professional advice of any kind, including but not limited to medical, legal, financial, or therapeutic advice.

You acknowledge that AI companions are fictional characters with simulated personalities. Interactions with Chitin are not a substitute for human relationships, professional counseling, or emergency services. If you are experiencing a crisis, please contact appropriate emergency services or a qualified professional.

You agree to use the Service responsibly and in compliance with all applicable laws. You may not:

• Use the Service for any illegal, harmful, or fraudulent activity
• Attempt to generate content that promotes violence, harassment, or discrimination
• Reverse engineer, decompile, or attempt to extract the source code of the app or its AI systems
• Use the Service to develop competing AI products or services
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and handle your data. By using the Service, you consent to the practices described in the Privacy Policy.

Conversations with Chitin are processed in transit through our relay service for AI response generation. Conversation content is not stored beyond your active session. We do not use your conversations to train AI models. For complete details on data collection and retention, see our Privacy Policy.

The Service relies on the following third-party services to function:

• Google Gemini — Provides AI language model processing. Your conversations are sent to Google's API, subject to Google's Privacy Policy.
• Anthropic Claude — Provides AI language model processing for paid tiers. Your conversations are sent to Anthropic's API, subject to Anthropic's Privacy Policy.
• Apple WeatherKit — Provides weather data when requested. Location data may be sent to Apple, subject to Apple's Privacy Policy.

We are not responsible for the privacy practices or content of third-party services. We encourage you to review the privacy policies of these providers.

The Chitin app, including its design, avatars, animations, code, and branding, is the intellectual property of Chitin, LLC. All rights reserved. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these terms.

Content you provide to the Service (your messages and inputs) remains yours. AI-generated responses are provided for your personal use and may not be attributed to Chitin, LLC as the author or originator of that content.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Chitin, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

In no event shall Chitin, LLC's total liability exceed the amount you paid for the Service in the twelve months preceding the claim.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability and Intellectual Property) will survive.

You may stop using the Service at any time. If you have an active subscription, remember to cancel it through your Apple ID settings to avoid continued charges.

We may update these Terms of Use from time to time. Changes will be reflected on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

These terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions.
